Streamlining Discovery at Heart of New Fair Labor Standards Act Protocols

The Fair Labor Standards Act (FLSA) impacts more than 130 million Americans by addressing the working conditions of men, women, and child laborers. These legal cases are now fraught with cost and delay, making the courts inaccessible for many and inefficient for all.

With the goal of creating a more efficient process for both parties and the courts, IAALS and the Federal Judicial Center (FJC) have released new FLSA Initial Discovery Protocols designed to streamline discovery in federal courts.

"[W]e are optimistic that as federal court judges embrace these new protocols, they will have the widespread impact of resolving FLSA cases more quickly and inexpensively," said the Honorable Jeremy Fogel, who directs the FJC.

They also indicated that journal and law review experience, extra-curricular activities, and class rank were less helpful—a trend consistent with respondents from other jurisdictions and a break from traditional notions of hiring criteria.

"Public trust in the judiciary is central to its legitimacy and to its capacity to enforce its orders," said Kourlis. "Retaining that impartiality, independence, and integrity of the judicial branch, I think in this day and age, is more critical than perhaps it’s ever been."
